Professional Negligence

Even when you take care to obtain professional advice, the adviser you use may make mistakes.

Fortunately not all of these mistakes result in a loss to you. Some mistakes are not sufficiently serious for the law to regard as negligent, but they may amount to poor service.

Our solicitors advise clients in York, North Yorkshire and beyond who have suffered from negligence or poor service from professionals.

There are time limits for bringing claims against professionals. The normal time limit is 6 years from the date of the negligent act which caused you loss. If you think you might have a claim, it is, therefore, important that you seek professional advice promptly.

Similarly there are sometimes time limits for referring complaints to professional bodies.

Our solicitors are experienced in helping you to go down the right route to seek a remedy for what has gone wrong. This saves you time, money and unnecessary stress.

We are happy to provide free preliminary advice either by telephone or in a meeting. We do offer a Conditional Fee (popularly known as ‘No Win, No Fee’) service, if we consider that you have a reasonable professional negligence claim. This includes arranging insurance for you to protect you against the risks of running a claim through the courts, if that is necessary. However, for most claims, it is our experience that negotiation produces a satisfactory outcome for clients.

Before offering a Conditional Fee Agreement it may be necessary to do some investigative work. In that case there may be some initial costs involved. If that is the case, we will discuss that with you when we first speak.

It may be more appropriate for you to pursue your grievance by way of a complaint to the adviser. If that is the case, we will tell you and discuss with you any help you may need in pursuing your complaint. It is generally necessary to pursue your complaint with your adviser first. Many professional bodies do offer complaint resolution procedures for complaints which your adviser does not resolve to your satisfaction.

Steven Partridge is particularly experienced in handling claims and complaints against solicitors, but we can also advise you on claims or complaints you may have against other professionals, such as surveyors, valuers and accountants.

As ever, our priority is to provide you with practical, cost-effective advice. For more information contact Steven Partridge at our Acomb office.
